These Terms of Use ("Terms") govern your access to and use of Mail Be Gone, a service operated by Marketing Right, LLC ("Mail Be Gone," "we," "us," or "our"). By creating an account or using Mail Be Gone, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility

You must be at least 16 years old and able to form a binding contract to use Mail Be Gone. By using the service, you represent that you meet these requirements.

2. The Service

Mail Be Gone connects to your Gmail account via Google's OAuth authorization and uses automated classification to sort, label, archive, or trash email according to your settings and preferences. You control what Mail Be Gone is allowed to do, can review and undo its actions, and can disconnect your Gmail account at any time.

3. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized access.

4. Subscriptions & Billing

Mail Be Gone offers a free plan and paid subscription plans as described on our Pricing page. Paid subscriptions are billed in advance on a recurring basis through our payment processor, Stripe, and automatically renew until canceled. You may upgrade, downgrade, or cancel your subscription at any time from your account settings; changes take effect according to the terms shown at checkout or in your billing portal. Except where required by law, fees are non-refundable.

5. Acceptable Use

You agree not to:

  • Use Mail Be Gone for any unlawful purpose or in violation of Google's terms of service;
  • Attempt to gain unauthorized access to our systems or another user's account or mailbox;
  • Reverse engineer, decompile, or attempt to extract the source code of our service;
  • Use automated means to scrape, overload, or interfere with the operation of the service;
  • Resell or provide the service to third parties without our written consent.

6. Your Content

You retain all rights to your email content and Gmail data. We process it only as needed to provide the service to you, as described in our Privacy Policy. We do not claim ownership of your email content and do not use it to train models for the benefit of other users.

7. Termination

You may stop using Mail Be Gone and delete your account at any time from your account settings, which permanently removes your Gmail connection and stored data and cancels any active subscription. We may suspend or terminate your access if you violate these Terms, misuse the service, or if required to comply with law.

8. Disclaimer of Warranties

Mail Be Gone is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that email classification will always be accurate, and you are responsible for reviewing important mail. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, Marketing Right, LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of Mail Be Gone. Our total liability for any claim arising out of these Terms or the service is limited to the amount you paid us in the twelve months preceding the claim.

10. Changes to the Service or Terms

We may modify or discontinue features of Mail Be Gone, and may update these Terms from time to time. If we make material changes, we will notify you by email or through the app. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws principles.
